TERMS OF SERVICE ACKNOWLEDGEMENT
Agreement Purpose and Acknowledgement
This Terms of Service and Limited Carrier Liability Acknowledgement (Agreement) records the legal terms for moving services supplied by the Carrier. By signing, the Customer confirms they have read the full document, had a chance to ask questions, and accept the liability limits, exclusions, claims process, and customer obligations described below.
New Zealand Legal Basis
This Agreement is governed by New Zealand law, including the Contract and Commercial Law Act 2017 (CCLA), relevant transport/carriage principles, and any other applicable statutes. Nothing in this Agreement removes rights that cannot legally be excluded; however, where liability may be limited by law, those limitations apply.
Definitions
Carrier means the moving company, including its employees, drivers, approved contractors, and agents. Customer means the booking party and any person acting on their instructions. Goods means all items tendered for move, pack, storage-in-transit, loading, unloading, handling, or transport. Transit means the period when Goods are on the moving vehicle during road carriage between addresses.
Scope of Services
Services may include quote-based labour, vehicle transport, loading, unloading, carrying, placement, wrapping, packing, unpacking, assembly, disassembly, and temporary staging. Services are supplied according to quote details, site conditions, and safe work limits. Any additional services requested on the day may incur additional charges.
Limited Carrier Liability in Transit
Carrier liability is limited under New Zealand law. Unless a different written contract and declared value arrangement is agreed before the move starts, liability is limited to the lower of actual proven loss or statutory/contractual limits. The Customer acknowledges this is limited liability and not full replacement insurance.
Transit-Only Trigger
Any carrier compensation exposure is intended for transit incidents (for example collision, rollover, or insured road-event damage while Goods are on the truck). This Agreement explicitly distinguishes transit carriage risk from handling risk at pickup or delivery premises.
Loading, Unloading, Handling and Packing Exclusion
The Customer acknowledges the Carrier is not responsible for breakage, denting, scratching, crushing, tearing, internal damage, or wear occurring during loading, unloading, carrying, stairs negotiation, doorway turns, lift transfers, manual handling, packing, unpacking, or furniture assembly/disassembly, except where mandatory law prohibits exclusion.
Fragile, High-Risk and Unsuitable Items
Goods made from glass, marble, stone, veneer, particleboard, MDF, flat-pack joints, antiques, art, electronics, gym equipment, and oversized/awkward items are moved at Customer risk unless specific written protective service and valuation terms are accepted. Carrier may refuse unsafe lifts or require specialist equipment at additional cost.
Prohibited and Restricted Goods
Customer must not include hazardous materials, explosives, flammables, illegal goods, perishable goods requiring special control, cash, jewellery, negotiable instruments, or irreplaceable personal documents unless explicitly agreed in writing. Undeclared restricted goods are moved entirely at Customer risk and may be refused.
Customer Responsibilities Before Move Day
Customer must provide accurate access details, parking permissions, building booking windows, weight limits, stair/lift information, and item dimensions. Customer must secure and prepare Goods, disconnect appliances, drain fluids where required, and ensure pathways are clear and safe. Delays from incomplete information can incur waiting or variation charges.
Site Safety and Right to Pause
Carrier may pause or refuse work where conditions are unsafe (including weather, blocked access, unsafe structures, aggressive behaviour, biological hazards, or non-compliant lifting demands). Time lost due to unsafe or inaccessible conditions may still be chargeable under the quote terms.
Timing, Delays and Force Majeure
Estimated times are good-faith estimates, not guarantees. Carrier is not liable for delay caused by traffic, weather, accidents, mechanical issues, road closures, customer readiness, building restrictions, or other events outside reasonable control. Carrier will attempt practical communication and rescheduling.
Charges, Variations and Payment
Customer agrees to quoted rates and any approved variations. Additional labour, difficult access, shuttle vehicles, waiting time, long carries, stairs, or non-disclosed items may increase cost. Payment is due as agreed in the booking. Carrier may retain Goods subject to lawful lien rights until outstanding invoices are paid.
Insurance and Customer Risk Cover
Carrier strongly recommends Customer obtains dedicated transit/move insurance. Carrier liability limits are not a substitute for insurance and may not cover full value of Goods. Customer is responsible for confirming insurance suitability with their insurer before move day.
Inspection and Claims Process
Customer must inspect Goods at delivery and record visible issues immediately. All claims must be lodged in writing within 7 calendar days from delivery, with photographs, item description, and proof of value. Late or unsupported claims may be declined. Carrier may elect repair, replacement, or capped compensation where legally required.
Consequential Loss Exclusion
To the extent allowed by law, Carrier is not liable for indirect or consequential loss, including business interruption, loss of profit, emotional distress, accommodation costs, missed settlement penalties, or any third-party contractual penalties linked to move timing or condition of Goods.
Indemnity
Customer indemnifies Carrier against third-party claims, penalties, and costs arising from Customer-provided instructions, unsafe premises, undeclared goods, inaccurate inventory details, or breach of this Agreement, except to the extent caused by Carrier wilful misconduct.
Privacy and Record Keeping
Carrier may collect and store booking details, contact details, signatures, timestamps, and acknowledgement records for legal compliance, dispute handling, and audit trails. Signed acknowledgements and related PDF records may be retained in the admin system for future reference.
Electronic Signature and Binding Effect
Customer agrees that electronic signature, typed confirmation, and date capture constitute a binding acknowledgement under applicable New Zealand electronic transactions principles. This signed record may be relied on in legal or dispute proceedings.
Entire Agreement and Severability
This document forms the full liability acknowledgement between Customer and Carrier for the booked move. If any clause is unenforceable, remaining clauses continue in force. Any special terms must be in writing and accepted before service commencement.
